1. TERM AND TERMINATION

These Legal Terms shall remain in full force and effect while you use the Services. WITHOUT LIMITING ANY OTHER PROVISION OF THESE LEGAL TERMS, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SERVICES (INCLUDING BLOCKING CERTAIN IP ADDRESSES), TO ANY PERSON FOR ANY REASON OR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE LEGAL TERMS OR OF ANY APPLICABLE LAW OR REGULATION. WE MAY TERMINATE YOUR USE OR PARTICIPATION IN THE SERVICES OR DELETE YOUR ACCOUNT AND ANY CONTENT OR INFORMATION THAT YOU POSTED AT ANY TIME, WITHOUT WARNING, IN OUR SOLE DISCRETION.

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

1. This Member Agreement shall continue to apply until terminated by either You or Goa Rent A Cab as set forth below. If You want to terminate Your agreement with Goa Rent A Cab, You may do so by (i) not accessing the Website; or (ii) closing Your Account for all of the Services that You use, where Goa Rent A Cab has made this option available to You.
2. You agree that Goa Rent A Cab may, in its sole discretion and without prior notice, terminate Your access to the Website and block Your future access to the Website if Goa Rent A Cab determines that You have violated the terms & conditions of this Member Agreement any other Policy(s) of the Website. You also agree that any violation by You of the Agreement(s) will cause irreparable harm to Goa Rent A Cab, for which monetary damages may be inadequate, and You consent to Goa Rent A Cab obtaining any injunctive or equitable relief that Goa Rent A Cab deems necessary or appropriate in such circumstances. These remedies are in addition to any other remedies which Goa Rent A Cab may have at law or in equity.
3. In addition to Clause 20.2 above, Goa Rent A Cab may, at any time, with or without notice, terminate these terms of the Member Agreement with You if:

• Goa Rent A Cab is required to do so by law (for example, where the provision of the Services to You is, or becomes, unlawful), or upon request by any law enforcement or other government agencies;

• The provision of the Services to You by Goa Rent A Cab is, in Goa Rent A Cab's sole discretion, no longer commercially viable;

• Goa Rent A Cab has elected to discontinue, with or without reason, access to the Website, the Services (or any part thereof); or

• In the event Goa Rent A Cab faces any unexpected technical issues or problems that prevent the Website and/or Services from working.

1. Goa Rent A Cab may also terminate or suspend all or a portion of Your Account or access to the Services with or without reason. Termination of Your Account may include (i) removal of access to all offerings within the Website or with respect to the Services; (ii) disabling access to the Account Information, including Your personal information, log-in ID and password, and all related information, files, and materials associated with or inside Your Account (or any part thereof), and any User Content uploaded by You; and (iii) prohibiting further use of the Services.
2. You agree that all terminations shall be made in Goa Rent A Cab's sole discretion and that Goa Rent A Cab shall not be liable to You or any third party for any termination of Your Account (and accompanying deletion of Your Account Information), or Your access to the Website and Services.
3. Notwithstanding the foregoing, such terms of this Agreement as are meant to survive termination/expiry of this Agreement, will survive indefinitely unless and until Goa Rent A Cab chooses to terminate them.

2. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Services. We also reserve the right to modify or discontinue all or part of the Services without notice at any given time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services.

We cannot guarantee that the Services will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Services, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Services at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime or discontinuance of the Services. Nothing in these Legal Terms will be construed to obligate us to maintain and support the Services or to supply any corrections, updates, or releases in connection therewith.

3. GOVERNING LAW

These Legal Terms shall be governed by and defined following the laws of India. Goa Rent A Cab and yourself irrevocably consent that the courts of India shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Legal Terms.

4. DISPUTE RESOLUTION

You agree to irrevocably submit all disputes related to these Legal Terms or the legal relationship established by these Legal Terms to the jurisdiction of the Goa-India courts. Goa Rent A Cab shall also maintain the right to bring proceedings as to the substance of the matter in the courts of the country where you reside or if these Legal Terms are entered into in the course of your trade or profession, the state of your principal place of business.

5. DISCLAIMER

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES' CONTENT OR THE CONTENT OF ANY WEBSITES OR MOBILE APPLICATIONS LINKED TO THE SERVICES AND WE WILL ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY (1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT AND MATERIALS, (2) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SERVICES, (3) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (4) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES, (5) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE SERVICES BY ANY THIRD PARTY, AND/OR (6) ANY ERRORS OR OMISSIONS IN ANY CONTENT AND MATERIALS OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES. WE DO NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE SERVICES, ANY HYPERLINKED WEBSITE, OR ANY WEBSITE OR MOBILE APPLICATION FEATURED IN ANY BANNER OR OTHER ADVERTISING, AND WE WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND ANY THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES. AS WITH THE PURCHASE OF A PRODUCT OR SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, YOU SHOULD USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHERE APPROPRIATE.

6. LIMITATIONS OF LIABILITY

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US. CERTAIN US STATE LAWS AND INTERNATIONAL LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.

7. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) use of the Services; (2) breach of these Legal Terms; (3) any breach of your representations and warranties set forth in these Legal Terms; (4) your violation of the rights of a third party, including but not limited to intellectual property rights; or (5) any overt harmful act toward any other user of the Services with whom you connected via the Services. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defence of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.

8. USER DATA

We will maintain certain data that you transmit to the Services for the purpose of managing the performance of the Services, as well as data relating to your use of the Services. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Services. You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.

9. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Services, satisfy any legal requirement that such communication be in writing. YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND OTHER RECORDS, AND ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND RECORDS OF TRANSACTIONS INITIATED OR COMPLETED BY US OR VIA THE SERVICES. You hereby waive any rights or requirements under any statutes, regulations, rules, ordinances, or other laws in any jurisdiction which require an original signature or delivery or retention of non-electronic records, or to payments or the granting of credits by any means other than electronic means.

10. MISCELLANEOUS

These Legal Terms and any policies or operating rules posted by us on the Services or with respect to the Services constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Legal Terms shall not operate as a waiver of such right or provision. These Legal Terms operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of these Legal Terms is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Legal Terms and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Legal Terms or use of the Services. You agree that these Legal Terms will not be construed against us by virtue of having drafted them. You hereby waive any and all defences you may have based on the electronic form of these Legal Terms and the lack of signing by the parties hereto to execute these Legal Terms.

11. DATA PROTECTION:

1. Goa Rent A Cab captures, stores, processes and uses the Member’s Personal data, including, but not limited to, name, e-mail id, internet protocol address, copy of driving license number and duly attested colour image of Voter ID or Passport on the letter head of the electoral officer and police officer respectively under whose jurisdiction the address falls), and any other additional address cum identity proof, image of the customer, the usage and vehicle data as they relate to the Member, to the extent this is necessary for the administration and implementation of this Agreement and the Member’s use of Goa Rent A Cab's vehicle.
2. Should third-party services be used, Goa Rent A Cab is entitled to forward to the third-party service provider the Member’s Personal data, to the extent this is required in order to fulfil the objectives of Goa Rent A Cab.
3. Goa Rent A Cab is entitled to provide Member’s Personal data to third-parties for the purposes of providing individualized offers, Services, and other customized information to Members.
4. Goa Rent A Cab shall implement and maintain reasonable procedures for protecting sensitive personal information in compliance with applicable law.
5. Notwithstanding anything contrary contained herein, Member shall be governed by the privacy policy of Goa Rent A Cab being mentioned on the website www.GoaRentACar.in

12. ARBITRATION & JURISDICTION FOR DISPUTES:

1. Any Dispute, controversy or claims by or between, Goa Rent A Cab and Member, hereto arising out of or relating to or in connection with terms and conditions of this Member Agreement or transactions contemplated on Website, or the breach, termination, validity of any term under this agreement shall be finally settled by ‘Arbitration’ in accordance with the Indian Arbitration and Conciliation Act, 1996. There shall be a sole arbitrator, who shall be appointed by Goa Rent A Cab. Any arbitration proceedings or award rendered hereunder and the validity, effect and interpretation of this agreement to arbitrate shall be governed by the Laws of India. The arbitration proceedings shall be conducted in Goa, and the award shall be rendered in the English Language. If either party employs attorneys to enforce any rights arising out of or relating to this Agreement, the prevailing party shall be entitled to recover reasonable attorneys’ fees.

(i) Subject to sub-clause (ii) the Member irrevocably agree that the courts in Goa are to have exclusive jurisdiction for the purpose of hearing and determining any litigation, suit, action or proceedings and/or to settle any disputes arising out of or in any way relating to this Agreement or its formation or validity ("Proceedings") and for the purpose of enforcement of any judgment against its property or assets

1. Nothing in this clause shall (or shall be construed so as to) limit the right of Goa Rent A Cab to initiate proceedings against any of its Members in accordance with mandates contained in Section 20 of the Civil Procedure Code, 1908.
2. Notwithstanding anything contained in the foregoing sub clauses, the jurisdiction in relation to criminal proceedings shall be governed in accordance with the provisions contained in Chapter XIII of the Code of Criminal Procedure, 1973.
3. Member agrees to pay Goa Rent A Cab's reasonable attorneys' fees and costs in any legal proceeding relating to this Agreement, including appeals, where the respective court or forum pronounces the order in favour of Goa Rent A Cab.
4. Member must not aid or encourage the filing of any third-party claim or lawsuit against Goa Rent A Cab, and Member must cooperate fully with Goa Rent A Cab and Goa Rent A Cab's insurer in the investigation and defence of any claim or lawsuit. In any proceeding involving the Member and Goa Rent A Cab as co-defendants should Goa Rent A Cab determine in its sole discretion that the Member’s independent attorney has not aligned his defence similar to that of Goa Rent A Cab, Goa Rent A Cab shall be entitled to call upon the Member to change his attorney to one advised by Goa Rent A Cab and the Member shall accordingly change his attorney at his own cost.
5. Member must immediately notify and deliver to Goa Rent A Cab every summons, complaint, document, or notice of any kind received by Member in any way relating to an accident, theft, or other circumstances related to Goa Rent A Cab vehicle.

13. SEVERABILITY AND INTEGRATED AGREEMENT:

If any term, provision, covenant or condition of this Agreement is held invalid or unenforceable for any reason, the remainder of the provisions will continue in full force and effect as if this Agreement had been executed with the invalid portion eliminated. The Parties further agree to substitute for the invalid provision a valid provision that most closely approximates the intent and economic effect of the invalid provision. This Agreement, together with the User Guide, Trip Process, Member Application, Fee Policy / Rate Schedule, and any applicable consent forms, along with any amendments hereto, encompasses the entire agreement between Member and Goa Rent A Cab, and supersedes all previous understandings and agreements between Member and Goa Rent A Cab. Member acknowledges and represents that he or she has not relied on any representation, assertion, guarantee, warranty, collateral contract or other assurance, except those set out in this Agreement, made by or on behalf of any other party or any other person or entity whatsoever, prior to the execution of this Agreement.

14. NO WAIVER:

No term contained in this Agreement may be changed or waived, except in writing signed by an expressly authorized representative of Goa Rent A Cab. No waiver of default by Member/ You under any of the Terms or Conditions of this Agreement shall be construed as a waiver of any prior or subsequent default of any of the Terms or Conditions of this Agreement. 

15. ASSIGNMENT OR TRANSFER:

The rights granted to the Member under this Agreement are not assignable or transferable, in whole or part. Any attempt to transfer this Agreement without the written consent of Goa Rent A Cab shall be void and of no force and effect. Goa Rent A Cab reserves the right and can at its absolute discretion can assign the rights and obligations under this Agreement to an affiliate or to another entity in connection with a corporate transaction or otherwise.

16. NO AGENCY:

Member will never be deemed to be Goa Rent A Cab's agent, servant, or employee in any manner for any purpose whatsoever. 

17. FORCE MAJEURE:

If performance of any Service or obligation under the terms and conditions of this Member Agreement or any other provisions of the policies of the Website, or other third parties in fulfilment of transaction (for e.g. home deliveries of vehicles, payment gateways etc.) are, prevented, restricted, delayed or interfered with by reason of labour disputes, strikes, acts of God, floods, lightning, severe weather, shortages of materials, rationing, utility or communication failures, earthquakes, war, revolution, acts of terrorism, civil commotion, acts of public enemies, blockade, embargo or any law, order, proclamation, regulation, ordinance, demand or requirement having legal effect of any government or any judicial authority or representative of any such government, or any other act whatsoever, whether similar or dissimilar to those referred to in this clause, which are beyond the reasonable commercial control of Goa Rent A Cab or its third parties performing such services as sub-contractor to Goa Rent A Cab and could not have been prevented by reasonable precautions (each, a "Force Majeure Event"), then Goa Rent A Cab shall be excused from such performance to the extent of and during the period of such Force Majeure Event. Goa Rent A Cab shall exercise all reasonable commercial efforts to continue to perform its obligations hereunder. 

18. COMMUNICATIONS.

When You use the Website or send emails or other data, information or communication to Goa Rent A Cab, You agree and understand that You are communicating with Goa Rent A Cab through electronic records and You consent to receive communications via electronic records from Goa Rent A Cab periodically and as and when required. Goa Rent A Cab will communicate with You by email or by notices on Website or electronic records on the Website or on Your mobile number which will be deemed adequate service of notice / electronic record to the maximum extent permitted under any applicable law, It is further clarified that You can also use the customer support e-mail, Facebook page and twitter handle of Goa Rent A Cab to share your words of appreciation pertaining to ride only.

19. FEEDBACK AND INFORMATION:

1. Any feedback You provide to Goa Rent A Cab shall be deemed to be non-confidential. Goa Rent A Cab reserves the right to use such information without any restriction. Further, by submitting the feedback, You represent and warrant that (i) Your feedback does not contain confidential or proprietary information of anybody including you and third parties; (ii) Goa Rent A Cab is not under any obligation of confidentiality, express or implied, with respect to the feedback; (iii) Goa Rent A Cab may have something similar to the feedback already under consideration or in development; and (iv) You are not entitled to any compensation or reimbursement of any kind from Goa Rent A Cab for the feedback under any circumstances.
2. To clarify, Goa Rent A Cab may at its discretion, make any modifications or changes to the Website, Content and / or Services on the basis of such feedback, however Goa Rent A Cab shall not be obliged to do so. Further, in the event that Goa Rent A Cab makes any changes or modifications to the Website, Content and / or Services on the basis of any such feedback, You shall not have any rights or title (including any intellectual property rights) in such changes or modifications to the Website, Content and / or Services. You expressly waive any and all rights in such changes or modifications to the Website, Content and / or Services, and assign to Goa Rent A Cab, all worldwide rights and title (including any intellectual property rights) to such changes or modifications to the Website, Content and / or Services, in perpetuity. You hereby waive all rights under Section 19(4) of the Indian Copyright Act, 1956, or other similar provisions in laws of any jurisdiction, in relation to any such changes or modifications to the Website, Content and / or Services.

At Goa Rent A Cab, we aim to provide a transparent and reliable car rental experience, and our terms and conditions are designed to ensure clarity and fairness. Please review the following policies before availing our services:

PRICING POLICY:

Our pricing structure operates on a daily basis, requiring a minimum booking period of two days for the initial reservation. The day is calculated from 9 am to the subsequent day's 9 am, ensuring clarity and consistency in our rental duration policy.

DRIVER REQUIREMENTS:

Possession of a valid driving license, with a minimum validity of two years, is a prerequisite for car rental. During the car rental process, it is mandatory to submit a photocopy of the driving license for verification purposes.

RENTAL CHARGES AND DEPOSITS:

Rates are applied on a calendar day basis, and additional hour charges align with the full-day rate. The responsibility for fuel costs lies with the renter. An initial deposit of Rs. 5000/- will be collected, with adjustments for higher-end models. Any expenses related to damage, scratches, or theft of accessories are the sole responsibility of the renter.

TAXES AND FEES:

GST/Regulatory Tax is applicable on the total bill amount as per government norms. Any change in the rate will be charged accordingly.

ACCIDENTS AND REPAIRS:

In the event of an unfortunate major or minor accident, the renter assumes responsibility for repair costs and associated garage downtime. Repairs will exclusively be carried out in collaboration with authorized dealers.

CLEANLINESS AND ADDITIONAL CHARGES:

A fee of Rs. 300/- will be charged if the car is not returned in a clean condition.

SERVICE AVAILABILITY:

Our services are accessible 24 hours a day for your convenience. Unlimited kilometres are allowed solely within the state of Goa; vehicles are restricted from being taken outside Goa.

DELIVERY AND PICK-UP SERVICES:

For your convenience, the vehicle can be delivered or picked up at an additional cost, contingent on the location. Kindly consult our pick-up and drop tariff for detailed information.

RATE CHANGES AND BOOKING CONDITIONS:

Our rates are subject to change without prior notice. Booking is categorized, and specific car models cannot be guaranteed, contingent on availability.

CANCELLATION POLICY:

A cancellation fee equivalent to 25% of total charges is applicable for cancellations made 48 hours before the scheduled car pickup time. Within 48 hours of the pickup time, cancellations are not permitted, and no refunds are issued for no-show reservations. Cancellation requests can be conveniently processed through the My Booking section upon logging into the respective account. Please note that no cancellations are entertained for car bookings on special occasions.

RESCHEDULE BEFORE START:

Modifications made more than 48 hours before the booking starts will not be charged. 

EXTENSION POST START: 

Extensions made within two hours of the booking end time will lead to the cancellation of the doorstep pickup. No refunds will be applicable.

SHORTENING POST START: 

No charges or refunds will be applicable. 

SHORTENING/ RESCHEDULING WITHIN THE 24 HOURS OF THE BOOKING START OR BOOKING END TIME:

Customers will not be able to change the booking start time or shorten the booking end time. No refunds will be applicable. However, customers can extend the booking at any time. 

LATE RETURN: 

A late return will be considered and charged as a full day rental. 

PRICING PLAN CHANGE: 

No changes in booking on the pricing plan. 

FREE KILOMETRES IN GOA: 

Unlimited kms in Goa – you can drive anywhere within the boundaries of Goa. 

MINIMUM DURATION: 

The minimum duration of a booking is 48 hours and will be charged as two calendar days. 

DISCOUNTS:

Discounts are applicable only on trips equal or greater than the duration of two calendar days (48 hours). A discount is applicable only on the booking fee (excluding the refundable deposit if any) paid in advance to book a car. Discounts will not be applicable on blackout days and peak season. You can find the list of blackout days/ peak season here.  Goa Rent A Cab reserves the right to cancel a booking if any unwarranted use of a discount is identified. 

FUEL POLICY:

In case of No Fuel Bookings, the vehicle should be returned by the Member at the completion of the booking with the fuel at the same level it was at the start of the booking. If the vehicle is returned with the fuel level lower than it was at the start of the booking then a refuelling penalty will be applicable. 

There will be no refund if the car is returned with excess fuel. 

SPEED GOVERNORS: 

The vehicle may have speed governors enabled in compliance with the applicable government regulations that limit the speed of vehicles up to 80 KMPH. 

BREAKDOWN OF THE VEHICLE:

1. The member will be responsible for the cost related to the repair, recovery, and loss of use of any Goa Rent A Cab vehicle resulting in any of the foregoing, up to the current damage fees as set forth in the Fee Policy/ Rate schedule. 
2. Where the member is not responsible for the breakdown of the Goa Rent A Cab vehicle, Goa Rent A Cab will refund an amount equal to the amount of unused hours of such a booking. Further, Goa Rent A Cab will not be liable for any further costs borne by the member as a consequence of the breakdown of the Goa Rent A Cab vehicle.

USAGE OF Goa Rent A Cab DRIVING CREDITS:

Customers will be able to use Driving credits up to 500 points of the booking amount after adjustments for discounts (excluding the refundable deposit if any) or up to 5,000 whichever is lesser. 

Note:

• Handover pursuant to the original booking, extensions and modifications are subject to availability of the vehicle.  
• You are liable for free Km within Goa. 
• All Refunds made shall be through the original payment account only within 7-10 working days. 
• Goa Rent A Cab reserves the right to charge a fee for specific pre-defined accessories. 
• A list of penalties that can be levied if members violate certain Goa Rent A Cab community rules.

RETURNING THE VEHICLE TO THE WRONG LOCATION: 

There will be a charge of INR 1000/- + Full day rental fee + Full late fee until the vehicle is returned to the right location. 

TRAFFIC AND PARKING VIOLATIONS: 

Members are responsible for the full payment of fines + INR 500 per 30 days late in payment.

NO SHOW: 

Bookings will stand cancelled if the member does not show up within four hours of the start time. No refunds will be applicable. 

OVER-SPEEDING >= 100 KM/H:

INR 2500 (over and above the government speeding fine that maybe levied). Expulsion of Goa Rent A Cab if over-speeding occurs in two bookings. 

SMOKING:

A sum of INR 1000 + damage costs related to the interiors of the vehicle.

WRONG FUELLING: 

The member will be liable for the full cost of damage to the vehicle + miscellaneous expenses arising out of the damages. 
Goa Rent A Cab would like to recommend that the member consults the RC Documents of the rented vehicle for information as to the correct fuel type.

KEY IS MISSING:

A sum of INR 10000 + replacement cost of the key will be charged. 

VEHICLE DAMAGE (ACCIDENTAL): 

The member will be responsible for any unintentional/accidental damage and will be liable for the damage as per the authorised dealer estimate.

VEHICLE DAMAGE (INTENTIONAL OR CONSEQUENTIAL):

In case of any intentional damage or damage caused to the vehicle as consequence of the member driving the car, even after the car is damaged and need urgent repair (Examples include but are not limited to): 
             a. Driving in water loggings resulting into engine breakdown. 

1. Driving after under body damages resulting into engine break down because of oil drainage. 
2. Driving while under the influence of alcohol or other intoxicants, 
3. Driving with clutch over pressing etc. 
4. Member will be liable for the full cost of repair post damage to the vehicle + loss of expected revenue arising out of the damage.

TOWING AND IMPOUNDING:

No cost if caused by vehicle failure. 

Full cost if caused by user neglect. 

CLEANING REQUIRED (INTERIORS):

Washing of removable items (floor mats etc.) would be charged at INR 500. Interior Washing/ Dry cleaning (for seat covers, door panels) would be charged at INR 1,500.

1. MEMBER’S RESPONSIBILITY:
2. Members are responsible for paying all tolls at the time they are due.
3. Goa Rent A Cab vehicles are registered within Goa permit.

By joining Goa Rent A Cab, the Member agrees to pay Goa Rent A Cab the costs, charges, fees and expenses set out in the Agreement, including specifically and without limitation those set forth in this schedule. The following is not exhaustive and other specific fees, costs and charges may apply. Other applicable costs will be communicated to the Member. Capitalized terms used in this schedule shall have the same meaning assigned to such terms in the Agreement.

If a Goa Rent A Cab member is violating the law or Goa Rent A Cab rules, for example by over-speeding or driving drunk, the member will be responsible for all damage, liabilities, and fines and could even face legal action.

PROHIBITED USES:

1. The use of Goa Rent A Cab Vehicles under the following conditions is prohibited: - 

1. Any speed race or competition.
2. For the purpose of towing, pushing, or propelling any trailer or any other vehicle.
3. For the primary business purpose of transporting people or operating a taxi service.
4. By any person who is under the influence of (i) alcohol or (ii) any drug or medication under the effects of which the operation of a vehicle is prohibited or not recommended. A zero-tolerance policy is adopted and a limit of 0.0% applies.
5. In the carrying out of any crime or any other illegal activity.
6. in an imprudent, negligent, or abusive manner or for any abnormal use of this vehicle;
7. By any person who has provided Goa Rent A Cab with false information or whose representations are determined to be false (including, without limitation, regarding his name, age, or address).
8. Driving a Goa Rent A Cab vehicle outside of Goa or any prohibited areas within Goa.
9. Driving while using a mobile phone or any other mobile communication device in any manner whatsoever, including while sending an SMS, emailing, using a cell phone with or without a hands-free device, otherwise using a mobile communication device that may distract you from driving or otherwise engaging in similar activities that may be prohibited by applicable law.
10. Using Goa Rent A Cab vehicle to transport flammable, poisonous, or otherwise hazardous substances for other than legally permissible household use or in amounts greater than what is usually consumed in a household.
11. Transporting objects with Goa Rent A Cab vehicle that could – due to their size, shape, or weight adversely impact the vehicle’s handling safety or that could damage the interior of Goa Rent A Cab vehicle or, by virtue of such object/s protruding outside, affect the safety of vehicles driving in the vicinity of Goa Rent A Cab vehicle.
12. Transporting more passengers than the prescribed seating capacity of the vehicle by manufacturer of the vehicle.
13. The foregoing examples are not intended to be an exhaustive list. Any unreasonable, unwarranted, illegal, unethical or inappropriate use of a Goa Rent A Cab vehicle except the personal use for travel, as determined by Goa Rent A Cab in its sole discretion, may be deemed a violation of these terms and conditions. Goa Rent A Cab may report to the authorities any use of a Goa Rent A Cab vehicle or other activities that are in violation of local, state, law or in violation of these terms and conditions.

1. Goa Rent A Cab may immediately suspend or terminate the use of its Service by any Member for a violation of any of the terms and conditions of Member Agreement. Upon suspension or termination, any existing reservations for the Member may be cancelled by Goa Rent A Cab at its sole discretion. In addition, Member will be absolutely responsible for any and all, losses, damages (direct/indirect), costs, charges, fees and expenses incurred by Goa Rent A Cab, as a result of a breach of any of these terms and conditions and Member unconditionally and irrevocably agrees that Goa Rent A Cab reserves the right to pursue the remedial action to recover the losses/damages suffered by Goa Rent A Cab from Member’s property including but not limited to his/her legal heirs/representative’s properties.

VEHICLE PICK-UP AND RETURN/ VEHICLE CONDITION:

1. You must pick up the selected vehicle at its designated location and return it secured, clean, and in good working order to the correct and designated location by no later than the end time of Your reservation. However, the handover of vehicle pursuant to your booking is subject to the availability of vehicle. Further, Goa Rent A Cab reserves the right to cancel any booking at its sole discretion with only consequence to return the fees collected at the time of returning the car.
2. Prior to taking possession of a vehicle, you must do an exterior walk-around and an interior look-over. Before driving the vehicle, you must advise Goa Rent A Cab of any damage or abnormality encountered on the vehicle or in the operation of the vehicle. If Goa Rent A Cab is not notified of a problem at the start of a reservation you will be deemed to be responsible for any problem with the vehicle discovered or reported after your reservation, including, without limitation, damage to the vehicle or lack of cleanliness. You may be charged a damage fee, a cleaning fee, or other applicable fees, and Goa Rent A Cab may suspend, or may even terminate your membership.
3. Member is required to immediately report to Goa Rent A Cab of any condition that impairs the driving functionality of the vehicle, such as poor driving feel or external or internal damage that renders the vehicle unsafe, including but not limited to, missing or inoperable signal or driving lighting, broken or missing rear-view mirrors and windshield glass.
4. Notwithstanding anything contrary contained under this policy, any damage caused to vehicle/Goa Rent A Cab because of your wilful misconduct or gross negligence, during such time when the vehicle is not in motion, will attract charges/fees as per the sole discretion of Goa Rent A Cab.

SAFETY:

1. Seat Belts and Child Restraints - Member is responsible for the safety of their children.
2. Complying with all applicable seat belt, speed limit and child restraint laws. It is being made crystal clear that Member must abide themselves with the maximum speed/ weight limit and any other instructions being displayed/ communicated by the authorities through marks or sign boards in various locations of the concurrent trip.
3. Protecting all children by properly using any child passenger restraint system that complies with the Motor Vehicle Safety Standards in the jurisdiction where the trip is initiated and where Goa Rent A Cab vehicle is driven during such trip.

SECURING Goa Rent A Cab VEHICLES:

1. Each time a member parks a Goa Rent A Cab Vehicle (either at the end of the reservation or during the reservation period), the member is responsible for securing the vehicle from external factors including human or general known adverse weather conditions.
2. Goa Rent A Cab encourages all its Members to take full responsibility of their belongings. In case of any Member claims to have left back any luggage or any phones or personal music devices inadvertently in Goa Rent A Cab vehicle after the Member completes his/her reservation, minutes of the successful return of the car post completion/termination of the reservation. Goa Rent A Cab shall not be held responsible for such loss or damage in any circumstances.

FEES AND ELIGIBLE REIMBURSABLE EXPENSES:

1. Member is subject to Goa Rent A Cab's fees policy being mentioned on the website www.GoaRentACab.com It entails the scenarios which covers all the fees including but not limited to rentals, excess kilometre driving charges, late fees, late charges, extensions fees, penalties or fines, if any etc.
2. An "Eligible Expense" is defined as – any fuel related expense, provided it reconciles reasonably with distance travelled; in pursuance of the standard industry mileage or Goa Rent A Cab's internal mileage standard.

MAINTENANCE AND CLEANLINESS:

1. Goa Rent A Cab will perform all necessary and required routine maintenance on all of its vehicles. However, Member is responsible for the cleanliness of vehicle and are expected to assist in helping Goa Rent A Cab to maintain the driving safety and performance of the vehicle, in particular during longer reservations or when the vehicle indicates that service or maintenance is required.
2. Vehicle may require Roadside Assistance from time to time. Goa Rent A Cab makes reasonable best efforts to provide Roadside Assistance support in all cases. If, however, a Member's need for Roadside Assistance results from a breach of these Terms and Conditions, the Member may be charged for the full costs of the towing, repair and maintenance.
3. Use of tobacco, cigarettes, cigars, and alcohol is absolutely prohibited inside Goa Rent A Cab vehicles. Member is subject to additional fine if evidence of smoking, chewing, drinking or dipping is found inside Goa Rent A Cab vehicles or complained of by a Member using the vehicle immediately following the Member’s reservation.
4. Burning any substance is absolutely prohibited in Goa Rent A Cab vehicles. This includes, but is not limited to tobacco, other drugs, and incense.
5. Pets are absolutely prohibited in Goa Rent A Cab vehicles, except for those vehicles designated “pet friendly”. Member is subject to additional fees, if evidence of pets is found in Goa Rent A Cab vehicles or complained of by a Member using the vehicle immediately following the Member’s reservation.

BREAKDOWN OR INCIDENTS:

1. All breakdowns or incidents involving Goa Rent A Cab vehicles must be reported to Goa Rent A Cab immediately by phone to 094208 48884 and visit us at Bharat petroleum pump, bus stand, New, near Carvalho Building, Mapuca, Goa 403510
2. Jump start. If you perform a jump start to Goa Rent A Cab vehicle, you must inform Goa Rent A Cab immediately by phone or through the mobile app). You are fully responsible for any damage that may result from the improper use of jumper cables or other tools. It is strictly forbidden to provide a jump start to any vehicle other than a Goa Rent A Cab vehicle.
3. Incident. In case of an incident involving property damage or any third party, the Member must fill out an official police report form and, mandatorily provide a jointly agreed-upon statement, complete Goa Rent A Cab's incident report form, and obtain the following information:
4. Date, time, and place of incident;
5. The license plate numbers of any other vehicles involved, their make and year, their identification number (serial number), and the insurance certificate's number (with name, address and phone number of the insurance agent). 
6. The names, addresses, and driver's license numbers of the persons involved in the incident.
7. The name, address, and driver's license number of the owner of the vehicle (if he or she is not the driver).
8. The name, addresses, and phone number of witnesses, passengers, and any other involved persons.
9. Circumstances of the incident describing immediate surrounding environment and car position prior to the incident 
10. A police report is required regardless of liability or fault. Member shall specify in his/her detailed written complaint to the police the actual facts only. Member shall ensure that such complaint shall not contain any discrepancy, inconsistencies or distortions from actual facts as the same would be detrimental to a valid insurance or other claim by Goa Rent A Cab. Any loss occasioned to Goa Rent A Cab due to a discrepant, inconsistent or distorted complaint by a Member shall be to the account of such Member.
11. Investigation and procedure. Member must provide to Goa Rent A Cab and any other claims adjustment service with the findings of any report or any notice relating to a claim or a lawsuit against Goa Rent A Cab regarding any incident involving a Goa Rent A Cab vehicle. Member agree to cooperate fully with Goa Rent A Cab in the investigation and defence of any such claim or lawsuit. A Member's accounts will be suspended until the investigation has been concluded.
12. The Member shall be responsible for the costs related to the repair, recovery, and loss of use of any Goa Rent A Cab vehicle resulting from any of the foregoing, up to the current damage fee, as set forth in the Fee Policy / Rate Schedule (if such costs are because of the fault of the Member or if the fault is not directly established to any other person/ entity, or where any cost is not paid / reimbursed by the insurer of Goa Rent A Cab vehicles or the insurer of the other vehicle involved in the accident).
13. Where the Member is not responsible for the breakdown of the Goa Rent A Cab vehicle, Goa Rent A Cab shall refund an amount equal to the cost of the unused hours of such booking. Further, Goa Rent A Cab shall not be liable for any further costs borne by the Member as a consequence of the breakdown of the Goa Rent A Cab vehicle.
14. In case of any accidents/damages, any out of court settlement initiated or accomplished by Members with the third parties without written consent of Goa Rent A Cab will be solely borne by the Member.

TRAFFIC VIOLATIONS:

1. You are responsible for any traffic violations incurred due to your inappropriate use of a Goa Rent A Cab vehicle. This includes, but is not limited to: unauthorised parking, excess speeding, breaking red light, photo enforcement, and toll violations. You are solely liable for all costs imposed due to any such violation during the concurrence of your trip/ride/booking, including fines for late payment and any processing fees added by the respective regulatory authority. You are liable for payment of all tolls and any fines for toll evasion. You must report such violations to a Goa Rent A Cab representative, as soon as possible, within the prescribed timeline for the violation (for example, if the case is being taken to court). Goa Rent A Cab will notify the Member immediately by e-mail after it comes to know about any of such violation and Member shall forthwith pay the relevant fine/s to the authority concerned and provide Goa Rent A Cab with the proof of such payment, failing which Goa Rent A Cab will pay those amounts and Member shall reimburse the same to Goa Rent A Cab at earliest. However, where Member has personal knowledge of such violations, Goa Rent A Cab will not be obligated to provide Member with the notification as above, but Member’s obligation to pay the relevant fine/s and notifying Goa Rent A Cab of such compliance will continue as aforementioned.
2. You must not leave a vehicle in a zone which has parking restrictions. If you leave the vehicle in such a restricted zone, you must immediately notify Goa Rent A Cab, and you will be responsible for any and all violation notices or towing charges incurred by Goa Rent A Cab. Additionally, financial penalties will be levied against you for any inconvenience caused to other Goa Rent A Cab member if the vehicle is unavailable for its scheduled reservation because of such parking violations as set out in the fee policy on the website i.e. www.GoaRentACab.in. 

REFUND POLICY:

To initiate a refund request due to cancellation, kindly commence the process through our official website. Refunds will be credited to your account within 7 days and will be processed using the same payment mode employed during the booking. Kindly notify us at info@GoaRentACab.in, including the booking ID, once the cancellation process is initiated. For additional information or assistance, please do not hesitate to reach out to us through the contact details provided. We operate the website https://www.GoaRentACab.in (the "Site"), the mobile application Goa Rent A Cab: Car Rentals in Goa (the "App"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").

We retain the discretion to revoke, reclaim, or modify any username selected if, in our sole judgment, it is deemed inappropriate, obscene, or objectionable. 5. AVAILING OF SERVICE AND PAYMENT

Booking Process:

Users have the flexibility to choose from the range of self-drive cars available on the Goa Rent A Cab website to access during the booking process, Users are required to:

• Select the self-driving car based on their specific requirements.
• Specify the start and end date, indicating the desired service period.
• Provide driver information details if not available in Goa Rent A Cab's records.
• Complete the payment for the selected self-drive car using Goa Rent A Cab's designated payment systems.

Extension of Duration:

In the event a User wishes to extend their booking duration, they must communicate the extension request to us. Goa Rent A Cab retains sole discretion to approve or deny such extensions. An extension request is permissible only if:

• Car feasibility during the extended period is confirmed.
• Fees for the extended period are paid in advance.

Scope of Goa Rent A Cab Self-Drive Car Rental Services:

Upon advance fee payment, Goa Rent A Cab undertakes to provide the following services to the User:

• Provision of pick and drop facility, if required.
• Assurance that the vehicle is in optimal condition, adhering to the prescribed maintenance schedule of automotive OEMs.
• In case of a breakdown attributable to a mechanical or electrical failure and not due to user-related damage, Goa Rent A Cab strives to offer the best resolution. This includes vehicle maintenance and cleaning services.
• Goa Rent A Cab is dedicated to delivering timely roadside assistance support in all circumstances.

We accept the following forms of payment:

- Credit Card

- Debit Card

- Bank Transfer

- UPI

To facilitate seamless transactions through our Services, you are required to provide accurate and up-to-date purchase and account information. Timely updates, including email address, payment method, and card expiration date, are essential to ensuring the completion of your transactions and facilitating communication as necessary. Sales tax will be added to purchases as deemed necessary, and prices are subject to change in INR. 

By placing an order, you authorize us to charge your selected payment provider for the total amount, encompassing purchase prices and applicable shipping fees. We reserve the right to rectify any pricing errors, even after payment has been initiated. Additionally, we retain the discretion to refuse any order and may limit or cancel quantities per person, household, or order. 

These restrictions may extend to orders under the same customer account, payment method, or sharing billing or shipping addresses. Furthermore, orders that appear to be placed by dealers, resellers, or distributors may be subject to limitations or prohibitions based on our sole judgment.

6. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make the Services available. The Services may not be used in connection with any commercial endeavours except those that are specifically endorsed or approved by us.

As a user of the Services, you agree not to:

• Systematically retrieve data or other content from the Services to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
• Trick, defraud, or mislead us especially in any attempt to learn sensitive account information such as user passwords.
• Circumvent, disable, or otherwise interfere with security-related features of the Services, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Services and/or the Content contained therein.
• Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Services.
• Use any information obtained from the Services to harass, abuse, or harm another person.
• Make improper use of our support services or submit false reports of abuse or misconduct.
• Use the Services in a manner inconsistent with any applicable laws or regulations.
• Engage in unauthorized framing of or linking to the Services.
• Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the Services or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Services.
• Engage in any automated use of the system, such as using scripts or using any data mining, robots, or similar data gathering and extraction tools.
• Delete the copyright or other proprietary rights notice from any Content.
• Attempt to impersonate another user or person or use the username of another user.
• Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats ("gifs"), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as "spyware" or "passive collection mechanisms" or "PCM").
• Interfere with, disrupt, or create an undue burden on the Services or the networks or services connected to the Services.
• Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Services to you.
• Attempt to bypass any measures of the Services designed to prevent or restrict access to the Services, or any portion of the Services.
• Copy or adapt the Services' software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.
• Except as permitted by applicable law, decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Services.
• Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Services, or use or launch any unauthorized script or other software.
• Use a buying agent or purchasing agent to make purchases on the Services.
• Make any unauthorized use of the Services, including collecting usernames and/or email addresses of users by electronic or other means to send unsolicited emails, or create user accounts by automated means or under false pretences.
• Use the Services as part of any effort to compete with us or otherwise use the Services and/or the Content for any revenue-generating endeavour or commercial enterprise.
• Use the Services to advertise or offer to sell goods and services.
• Sell or otherwise transfer your profile.

7. MOBILE APPLICATION LICENSE

Use License

If you access the Services via the App, then we grant you a revocable, non-exclusive, non-transferable, limited right to install and use the App on wireless electronic devices owned or controlled by you and to access and use the App on such devices strictly in accordance with the terms and conditions of this mobile application license contained in these Legal Terms. You shall not: (1) except as permitted by applicable law, decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the App; (2) make any modification, adaptation, improvement, enhancement, translation, or derivative work from the App; (3) violate any applicable laws, rules, or regulations in connection with your access or use of the App; (4) remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) posted by us or the licensors of the App; (5) use the App for any revenue-generating endeavour, commercial enterprise, or other purpose for which it is not designed or intended; (6) make the App available over a network or other environment permitting access or use by multiple devices or users at the same time; (7) use the App for creating a product, service, or software that is, directly or indirectly, competitive with or in any way a substitute for the App; (8) use the App to send automated queries to any website or to send any unsolicited commercial email; or (9) use any proprietary information or any of our interfaces or our other intellectual property in the design, development, manufacture, licensing, or distribution of any applications, accessories, or devices for use with the App.

Apple and Android Devices

The following terms apply when you use the App obtained from either the Apple Store or Google Play (each an "App Distributor") to access the Services: (1) the license granted to you for our App is limited to a non-transferable license to use the application on a device that utilizes the Apple iOS or Android operating systems, as applicable, and in accordance with the usage rules set forth in the applicable App Distributor’s terms of service; (2) we are responsible for providing any maintenance and support services with respect to the App as specified in the terms and conditions of this mobile application license contained in these Legal Terms or as otherwise required under applicable law, and you acknowledge that each App Distributor has no obligation whatsoever to furnish any maintenance and support services with respect to the App; (3) in the event of any failure of the App to conform to any applicable warranty, you may notify the applicable App Distributor, and the App Distributor, in accordance with its terms and policies, may refund the purchase price, if any, paid for the App, and to the maximum extent permitted by applicable law, the App Distributor will have no other warranty obligation whatsoever with respect to the App; (4) you represent and warrant that (i) you are not located in a country that is subject to a US government embargo, or that has been designated by the US government as a "terrorist supporting" country and (ii) you are not listed on any US government list of prohibited or restricted parties; (5) you must comply with applicable third-party terms of agreement when using the App, e.g., if you have a VoIP application, then you must not be in violation of their wireless data service agreement when using the App; and (6) you acknowledge and agree that the App Distributors are third-party beneficiaries of the terms and conditions in this mobile application license contained in these Legal Terms, and that each App Distributor will have the right (and will be deemed to have accepted the right) to enforce the terms and conditions in this mobile application license contained in these Legal Terms against you as a third-party beneficiary thereof.

8. SERVICES MANAGEMENT

We reserve the right, but not the obligation, to: (1) monitor the Services for violations of these Legal Terms; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Legal Terms, including without limitation, reporting such user to law enforcement authorities; (3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof; (4) in our sole discretion and without limitation, notice, or liability, to remove from the Services or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and (5) otherwise manage the Services in a manner designed to protect our rights and property and to facilitate the proper functioning of the Services.

9. DATA PROTECTION:

1. Goa Rent A Cab captures, stores, processes and uses the Member’s Personal data, including, but not limited to, name, e-mail id, internet protocol address, copy of driving license number and duly attested colour image of Voter ID or Passport on the letter head of the electoral officer and police officer respectively under whose jurisdiction the address falls), and any other additional address cum identity proof, image of the customer, the usage and vehicle data as they relate to the Member, to the extent this is necessary for the administration and implementation of this Agreement and the Member’s use of Goa Rent A Cab's vehicle.
2. Should third-party services be used, Goa Rent A Cab is entitled to forward to the third-party service provider the Member’s Personal data, to the extent this is required in order to fulfil the objectives of Goa Rent A Cab.
3. Goa Rent A Cab is entitled to provide Member’s Personal data to third-parties for the purposes of providing individualized offers, Services, and other customized information to Members.
4. Goa Rent A Cab shall implement and maintain reasonable procedures for protecting sensitive personal information in compliance with applicable law.
5. Notwithstanding anything contrary contained herein, Member shall be governed by the privacy policy of Goa Rent A Cab being mentioned on the website www.GoaRentACab.in
